Secure Jobs, Better Pay Review – We Need Your Input!

The Southern Gold Coast Chamber of Commerce recently participated in a significant roundtable discussion on the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022.

This event brought together Chamber Presidents from across the state under the guidance of Business Chamber Queensland. The aim was to explore the impacts of these major legislative changes and their implications for local businesses.

Your Input Matters

The first package of the legislation, passed in December 2022, is currently under review. Business Chamber Queensland has confirmed that feedback from Chambers will directly inform their advocacy to the Federal Government in early 2025. As part of this process, we are seeking input from our members on key aspects of the legislation and its effect on your operations.

We encourage all members to email their responses to the questions below to president@sgc.org.au by Friday, December 27, 2024. Your insights are invaluable in shaping our collective voice and ensuring your experiences are represented.

Key Questions for Feedback

  1. Bargaining and Agreements: Have you negotiated an enterprise agreement since June 2023? If so, was the process easier, more difficult, or unchanged compared to previous agreements?

  2. Fixed Term Employment: Has the two-year limit on fixed-term contracts impacted your hiring practices? Are any of the exemptions relevant to your operations?

  3. Flexible Working Arrangements: Have you faced challenges in responding to requests for flexible working arrangements under the new procedural obligations?

  4. Pay Secrecy: Has the prohibition on pay secrecy clauses impacted your business, and if so, how?

  5. Industrial Action: Have the amendments introducing compulsory conferences at the Fair Work Commission before protected industrial action affected your enterprise?

  6. Multi-Employer Bargaining: Have you noticed changes in how unions or employees approach bargaining, such as interest in multi-enterprise agreements?

  7. Better Off Overall Test (BOOT): Were you required to make undertakings to satisfy the BOOT for your latest enterprise agreement?

  8. Exemptions for Fixed Term Employment: Are there additional circumstances or scenarios you believe should be exempted from the fixed-term contract restrictions?

  9. Legislative Goals: To what extent have the amendments achieved their goals of boosting job security, tackling gender inequity, and enhancing bargaining?

  10. General Feedback: Do you have any further observations or comments about the impact of the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022?
